Right of Cancellation

You have the right to cancel this contract within fourteen days without stating any reasons. The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have/has taken possession of the last goods.

To exercise your right of cancellation, you must inform us (Jan Kath Design GmbH, Friederikastr. 148, 44789 Bochum, Germany, email: info@jan-kath.de, Phone: +49 234 9412344) by means of a clear statement (e.g., a letter sent by post, or email) about your decision to cancel this contract. You may use the attached model cancellation form, but it is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we are informed about your decision to cancel this contract. We will carry out such reimbursement using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You will only have to pay for any diminished value of the goods if this value loss results from handling them in a way which is not necessary for checking the quality, characteristics, and functioning of the goods.

Special Notes

If you finance this contract with a loan and later revoke it, you are no longer bound to the loan agreement, provided both contracts form an economic unit. This is typically assumed if we are your loan provider or if your loan provider relies on our cooperation with respect to the financing. If the loan has already been received by us when the cancellation becomes effective, your loan provider with respect to the legal consequences of the cancellation or return steps into our rights and obligations from the financed contract. The latter does not apply if the present contract is about the acquisition of financial instruments (e.g., securities, foreign currencies, or derivatives).

If you want to avoid a contractual obligation as much as possible, exercise your right of cancellation and also cancel the loan contract if you also have a right of cancellation for it.
